Un piropo podría llevarlo usted a la cárcel

“Si como lo mueve lo bate, qué rico ese chocolate…”.

Para muchas mujeres un piropo en la calle por parte de un desconocido, ya sea galante, coqueto o con una connotación sexual, es parte de un rasgo “cultural” machista, que las mujeres reciben como algo inevitable. Ahora bien, para otras mujeres un piropo desagradable se considera una insolencia, una expresión de acoso o la previa del abuso. ¿Quién pone el límite, si la calle es de todos?

La representante a la Cámara por el Partido Verde, Katherine Miranda, presentó un proyecto de ley que propone castigar a las personas que lancen piropos vulgares o caigan en el abuso verbal hacia otra persona en lugares públicos, con prisión de dos a cuatro años.

Si bien existe una delgada línea entre los halagos y los piropos ofensivos, lo que busca este proyecto de Ley es que se tipifique como delito el acoso callejero, y esto dependerá, en caso de ser aprobado, de que las personas vulneradas formulen el respectivo denuncio.

La iniciativa pretende reformar el artículo 210 del Código Penal, así: “el que sin mediar consentimiento acose, asedie física o verbalmente, realice exhibicionismo, tocamientos, filmaciones o cualquier otra conducta de connotación sexual inequívoca o contenido sexual explícito en espacio público o de acceso público, incurrirá en prisión de dos a cuatro años siempre que la conducta no constituya por sí misma otro delito”.

Lo que se busca es que esta conducta se adicione como artículo 210-B en el Código Penal, es decir, a la Ley 599 de 2000.

La propuesta de la representante Miranda cuenta con el apoyo de Ángela María Robledo (Partido Verde), Yenica Sugein Acosta (Centro Democrático), Astrid Sánchez (Partido de la U), Elizabeth Jay-Pang Díaz (Partido Liberal), Flora Perdomo (Partido Liberal), Karen Violette Cure (Cambio Radical), Mónica Valencia (Partido de la U), Martha Villalba (Partido de la  U), Kelyn González (Partido Liberal), Liliana Benavides (Partido Conservador), Mónica Raigoza (Partido de la U), Sara Elena Piedrahíta (Partido de la U), Estefanía Rojano (Cambio Radical), Norma Sánchez (Partido de la U) y Jezmi Barraza (Partido Liberal).

Bélgica fue el primer país en imponer sanciones contra el acoso verbal. Sucedió en 2014, en parte gracias a la repercusión que tuvo en toda Europa Femme de la Rue, documental realizado por una estudiante de cine que muestra el día a día de la realizadora en un barrio multiétnico de Bruselas, donde cada vez que pisaba la calle era interpelada por hombres que se permitían todo tipo de comentarios, lo que la llevó a cambiar su forma de vestir, de moverse, e incluso a preguntarse si era culpa suya.

También influenciado por el activismo de la asociación peruana Paremos el Acoso Callejero, y de su vídeo denuncia ‘Sílbale a tu madre’, Perú aprobó una ley que define el acoso como aquel acto que impacta la libertad y la dignidad de movimiento o cualquier otro derecho a la integridad física y moral de una persona, ofensas que conllevan penas de hasta 12 años de cárcel. En Argentina, mientras tanto, tres proyectos de ley buscan prevenir el “hostigamiento” a las mujeres en la calle.

En Portugal, tras dos años de debate, se llevó o a cabo una reforma de ley a principios de 2016 que tipifica el abuso verbal callejero como un delito cuyas penas pueden ir de los 120 euros de multa hasta un año en prisión.

Por ahora, comienza el trámite en el Congreso para ponerles límite a esos piropos con los que muchas mujeres se sienten abusadas.
